Bengal Exam – Website and Service Terms & Conditions (General)

The Bengal Exam website (the “Website”) and its connected services (together referred to as the “Service”) are operated by Binapani Enterprise (“Bengal Exam,” “we,” or “us”). By accessing or using any part of the Service, you confirm that you have read, understood, and agree to follow these Terms and Conditions of Service (“Terms”).

BengalExam reserves the right to revise or update these Terms at any time. If changes are made, we will display a notice on the Website for at least seven (7) days after the update, along with the date of the last revision. Such modifications become effective either (i) after this 7-day notice period ends, or (ii) from your first use of the Service after the changes are posted—whichever occurs earlier. If you do not agree with these Terms, you are not authorized to use the Service.

1. Description of the Service

Bengal Exam provides an online platform for exam preparation. Services may include:

Online Test Series (e-module)

Printed versions of test modules

Evaluation services (as selected by users)

Learners can participate in various educational activities offered on the platform. BengalExam may, at any time, modify, improve, suspend, or discontinue part or all of the Service, temporarily or permanently.

2. Registration

When registering to use Bengal Exam, you agree to:

Provide accurate, current, and complete personal/organizational details.

Keep your password and account details confidential.

Update your registration information promptly if it changes.

Take full responsibility for all activities carried out through your account.

Consent to BengalExam contacting you via phone/SMS/email for product updates, promotions, offers, delivery updates, etc., even if you are listed under DND/DNC/NCPR.

Provide exam registration details if required for internal success tracking. Failure to do so may result in restricted access to services without refunds. (This information will not be shared externally.)

3. Subscriptions

You may subscribe to Bengal Exam’s services either:

Monthly or annually via third-party platforms (e.g., Google, Apple), or

Directly through Bengal Exam’s website.

Payments & Renewals

Payments may be processed either through Bengal Exam’s partners or the platform provider.

Rates are displayed on the app/website and may change at any time.

All payments are non-refundable.

Subscriptions auto-renew unless cancelled as per the Terms.

If purchased through a third party, billing disputes must be resolved with them.

Free Trial

Bengal Exam may offer free trial periods. If you do not cancel before the trial ends, your subscription will automatically convert into a paid plan.

Auto-Renewal

Paid subscriptions automatically renew. Charges will be applied at the then-current subscription rate (plus taxes) until you cancel.

4. User Responsibilities

You confirm that:

Your use of the Service will comply with Indian law and other applicable regulations.

You own or have the rights to all materials submitted to Bengal Exam and grant Bengal Exam a license to use them.

5. Inappropriate Use

You may not post or share any content that is defamatory, abusive, threatening, harassing, hateful, offensive, unlawful, or violates another person’s rights (including copyright or trademark). Bengal Exam may remove content it deems objectionable.

6. Indemnity

You agree to indemnify Bengal Exam, its employees, officers, agents, and affiliates against all claims, damages, liabilities, or expenses arising from your misuse of the Service or violation of these Terms.

7. Disclaimer of Warranties

The Service is provided “as is.” Bengal Exam makes no guarantees regarding accuracy, reliability, error-free operation, or uninterrupted access. We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

Bengal Exam shall not be liable for indirect, incidental, or consequential damages, including data loss, business interruption, or profit loss. In any case, liability is limited to the amount paid by you to Bengal Exam within the 12 months prior to the claim.

9. Termination

Bengal Exam may suspend or terminate your account at any time, without notice. You may close your account by following the instructions provided. Certain sections (intellectual property, warranties, liability, etc.) will survive termination.

10. Intellectual Property & Activity Data

All Service content (text, images, designs, software, e-books, etc.) is owned by Bengal Exam or its licensors. You may not copy, modify, or distribute it without permission. Data generated from your usage (Activity Data) belongs exclusively to Bengal Exam.

11. Trademarks

“Bengal Exam” and associated logos are trademarks of Bengal Exam. Accessing the Service does not grant you rights to use them without consent.

12. Privacy

Your use of the Service is governed by our Privacy Policy, available at: [www.bengalexam.com/privacy].

13. Cancellation Policy

Cancellations are allowed only within 24 hours of purchase.

Orders already processed/shipped cannot be cancelled.

Special-offer products (festival or exam-based promotions) cannot be cancelled.

Issues must be reported within 24 hours of product delivery for review.

14. Refund Policy

Refunds apply only before dispatch or before login credentials are shared.

Refunds are processed within 14 business days to the original payment method.

Order ID and reason must be provided for processing.

As per IT Act 2000 and Consumer Protection (E-Commerce) Rules 2020:

If you believe content on Bengal Exam infringes your copyright, you may submit a written notice with:

Description of copyrighted work

Location of infringing material on the Service

A good faith statement of unauthorized use

A declaration under penalty of perjury that your claim is accurate

17. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts in Mumbai shall have exclusive jurisdiction over any disputes.

18. Miscellaneous

These Terms are the entire agreement between you and Bengal Exam.

If any provision is unenforceable, the rest remain valid.

Bengal Exam may transfer its rights under these Terms without notice.
